Terms & Conditions

1 – General Terms – Digital Art Commission

  1. Prices provided may change depending on requirements, the deadline & complexity of the commission.
  2. I have the right to reject any order for any reason.
  3. If you want a commission for commercial use please contact at info@tineline.art
  4. No client nor non-client has permission to use my work outside of the discussed cases (e. g. commercial use if not discussed, reproduction, re-selling, NFT)
  5. I may post commissions on my social media and website as I like, if you do not wish them to be published please let me know beforehand.
  6. Please do not hesitate to provide reference images of any kind, they can be photographs, other artwork, videos etc.

2 – Process and Delivery

  1. A general timeline will be provided to you during the discussion process, if something changes you will be notified. Depending on complexity my processing time starts from 3 weeks and may go up.
  2. After the commission if accepted your rights to refund are gone.
  3. There will be updates on the status of your commission. I will contact you for feedback and provide step-by-step updates. I have the right to increase pricing if the feedback goes outside of the beforehand discussed realm.
  4. The finished digital commission will be send to you via email in high resolution. There will be no physical product.

3 – Payment

  1. Via PayPal invoice only. My prices are in $USD or €Euro.
  2. Commissions can be paid either 100% upfront or split 50% upfront and 50% after sketch approval, this excludes sketch commissions

  3. Don’t send me any payment before I have agreed to give you a slot and requested you to send me the payment

4 – Revisions

Two rounds of revisions are included in the pricing. I am happy to change something you don’t like, as long as it does not go outside of the beforehand discussed realm of the commission. If you wish to change the whole piece I will have to add additional fee. I will provide step-by-step updates (such as sketch, half-way and final result) to avoid miscommunication and ensure an end result that you are happy with. Please note:

  1. A fee will be added if you want something changed on the final drawing – unless, of course, a misunderstanding from my side has been made.
  2. Big changes will be charged with an additional fee, smaller changes that take more no more then 30 minutes are free of charge.

5 – Copyright / Usage

I, Tineline.Art (the artist):

  • I reserve the right to cancel and refund the order at any time for any reason.

  • I retain all copyrights over the commissioned artwork and promote it myself with it everywhere 

  • I will NOT claim the intellectual property (IP) of the commissioned artwork.

  • Post it on my social media and website to my liking (social media, website, portfolio, books etc.)

Please note: If you have any reasons against this, I am absolutely willing to discuss it beforehand.

 

The buyer is allowed to:

  • Use the commissioned piece for personal use unless agreed otherwise (social media, personal website, print at home – as long as it is not monetized)
  • You may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, NFTs, make prints, etc.)
  • You may NOT alter the commissioned artwork without my (the artist’s) consent. Please discuss with me beforehand.
  • You may NOT use the commissioned artwork for commercial purposes.
  • You may get the design tattooed if discussed beforehand. Tattoo design commissions are free to get tattooed on the customer. If you are a tattoo artist please contact me beforehand.

The following is considered copyright infringement:

  • Reproducing / using the copyrighted artwork commercially; means making money off it in any way
  • Claiming the artwork as your own
  • Removing my signature
  • Altering the artwork without my consent
  • The commercial rights to the image may be purchased

6 – Refunds / Cancellation

  1. The buyer is not allowed a refund once I have started working on the commission.
  2. I will not send an invoice before I know I’m ready to start on your commission. I start sketching as soon as payment has been received. Meaning, if you’ve paid, there’s no refunds
  3. If for any reason I am unable to start your commission you will receive a full refund
  4. You may cancel your order free of charge before paying
  5. If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself
  6. If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all before mentioned rights to the commissioned piece and I will have the full right to profit further from it in any way.

7 – Commercial Usages

If you wish to purchase the rights to a completed image, you will have to pay a rights fee. A rights fee gives you all rights to the image for resale. This means you can use it for stickers, apparel, book/album covers, etc. depending on which fee you have paid for.

Full Rights for Commercial Resale: Royalties which include 10% of your sales. Can be payed monthly or quarterly. Price may change depending on the project – we can discuss this beforehand.

This means you may use this work for resale, without the artist (myself, Tineline.Art) receiving any income for your sales. E.g.merch, book/album covers, promotional material, streams, etc.

NOTE: If the buyer breaks any of the points stated above they will lose all the aforementioned rights to the artwork commissioned by me, Tineline.Art (the artist), and I will have the right to profit further from the commissioned artwork in any way I see fit. If you have a problem with any of these statements, they may be changed if discussed with me prior to paying your commissioned piece.

8 – What Do You Get?

  1. Drafts mockups and at least one Sketch which you can approve
  2. Final sketches with color concept if needed
  3. Step-by-step updates depending on the project (at least two)
  4. For tattoo designs: clean lineart template which can be used as stencil by your tattoo artist
  5. Full-resolution image (at least 2500x2500px but please let me know beforehand which size you prefer/need) of the final drawing as .jpg send to you via Email. Other formats such as .png and .pdf can also be provided if you want

9 – What I Do / Don’t Draw

Do:

  • You, Your family/friends/pets
  • Your original characters
  • Fanart
  • Humanoids/fantasy humanoid characters
  • Couples of any gender
  • Animals of any kind

Don’t:

  • Anthros
  • Mecha
  • Hateful content
  • Gore
  • 1 to 1 copies of existing artwork/tattoo designs – I will always make sure to put my own spin on things

Please note that I am happy to try new things depending on the commission, complexity and pricing of the piece. 10 – Ending notes

These Terms & Conditions are subject to change at any given time.

Please send me an inquiry if you’d like to commission me! When you fill out the form, please make sure to include references like characters, poses, colors, other artwork you like etc. The more the better.
